Party of Five helped to bring Scott Bairstow a degree of fame. Now an alleged illicit party of two might bring the actor some serious jail time.

Bairstow, a 33-year-old married father of two who played Neve Campbell (news)'s abusive boyfriend Ned on Po5, has been charged with having sex with a 12-year-old girl.

The actor, whose acting résumé includes last year's Disney kid flick Tuck Everlasting along with TV stints in Lonesome Dove and the short-lived sci-fi series Wolf Lake and Harsh Realm, was charged with second-degree rape of a child Tuesday in Snohomish County, Washington. The actor, now an L.A. denizen, was not arrested. He is due in court for arraignment on June 3.

Bairstow's manager, Andrea Pett-Joseph, was not immediately available for comment Thursday.

According to court documents obtained by the Herald of Everett, Washington, the girl, a relative by marriage, told police she and Bairstow first started having sex in 1998. At the time Bairstow lived in the area with his wife and children.

After the initial encounter, which allegedly took place when the girl was visiting Bairstow's home and playing on his computer, the two had sex three more times outside Washington state, most recently in 2001, according to court papers.

Prosecutor Janice Albert said that the victim became physically ill following the final episode. "The defendant apologized and asked her not to tell anyone," Albert writes in the court papers.

Earlier this year, with Bairstow in Los Angeles with his wife Marty and sons Casey and Dalton and working steadily, he began asking the girl, now 17, for phone sex. She told prosecutors that the actor asked "her to tell him that she was a little girl," according to Albert.

In April, the girl eventually told her parents--who didn't know about the sex but were wary of their daughter's relationship with Bairstow--and they contacted the authorities, who obtained court permission to tap the family's phones and record the girl's conversations with Bairstow.

During one conversation quoted in court papers, the girl said she was thinking about telling someone about Bairstow. The actor is quoted as saying, "Well...I'm a dad and I've got a job, and if you were to tell anyone I would be thrown in jail for 10 years."

He's not too far off. According to Washington state sentencing guidelines, Bairstow, as a first-time offender, would most likely face between six and eight years in prison if convicted.

Seems to me that something's wrong when a man who rapes a little girl repeatedly only gets up to 8 years.

yeah..well you still have to prove he did it too...the courts still don't take a lot of these cases seriously cause they say that little girls hear adults talking and get ideas in their heads and once they do, they become convinced that it happened to them when it really didn't. Granted this girl was older so it might make a difference but with the little girls who are only 3-8..it almost never matters. On top of that, it is horrible facing everyone. The victum is made to feel like it was her fault somehow and that if she says anything that people will hate her, call her a liar and that she will shame the family. There is much more of this going on than people will ever realize and until more of it is punished harsher and made more public...it won't ever stop either... Cry

I, for one, love seeing all these celebrities being nailed in the press lately. It shows me things are changing and that even if the courts let him off, it's unlikely he'll ever work again, at least not in anything credible or worth the paycheck.
