LA Times Poll: Davis Should Be Recalled

LOS ANGELES - A majority of voters believe Gov. Gray Davis (news - web sites) should be recalled in a special election, according to a poll published Friday, hours after recall leaders claimed they had enough support to put the question on the ballot.

The Los Angeles Times statewide poll of 1,412 adults, 1,127 of them registered voters, found 51 percent want Davis ousted, while 42 percent would reject a recall. The rest said they didn't know what to do.  
 
 
Many pointed to the state's $38 billion fiscal crisis as the reason Davis should be removed. Others gave the Democrat poor ratings on education and energy.  
 
 
"I find it incredible that when he took office we had a surplus in this state, and now we're in the hole," Teri Hoerntlein, a 37-year-old San Bernardino County independent, told the newspaper. "If this were a private business, we would have had to declare bankruptcy."  
 
 
Despite the increasing support for removing Davis — a Times poll in March had found 39 percent of voters favored a recall_ many of those in Friday's poll lost their enthusiasm once they learned a special election would cost at least $25 million.  
 
 
The latest Times poll was conducted from June 28 to July 2. Both polls had margins of sampling error of plus or minus 3 percentage points.  
 
 
Whether the recall goes to a special election or not will come down to the signatures on the petitions.  
 
 
By law, backers need 897,158 validated signatures of registered voters by July 16 to put the question to voters this fall. Ted Costa, coordinator of the Republican-led signature drive, said Thursday that just over 1 million signatures had been turned over to counties for validation.  
 
 
Opponents were skeptical and noted state officials had yet to validate the signatures.  
 
 
"The rhetoric has yet to match the reality," said Carroll Wills, spokesman for Taxpayers Against the Governor's Recall. Opponents said they had 1.1 million signatures on petitions opposing the recall, though those petitions would have no legal effect.  
 
 
As for a possible replacement for Davis, the poll found the most support for Sen. Dianne Feinstein (news, bio, voting record), D-Calif., followed by former Los Angeles Mayor Richard Riordan, who lost the Republican primary last year, when Davis was re-elected. Republican actor Arnold Schwarzenegger trailed, with more than half of those polled saying they wouldn't vote for him.

He filled out the papers giving him the legal option to run.  I read that in a news article last night, that he flew home from promoting to fill out paperwork before the deadline.  He can still opt not to run ultimately.  In the press he said a few times that he would run if they recalled Davis.

SAN FRANCISCO, California (AP) -- The outcome of California's anything-goes recall effort could be determined by the state's highest court, where Gov. Gray Davis added his own complaints Monday to a docket already crowded with legal challenges to the election.  
 
Legal experts said the governor's case is among the strongest of the five challenges pending before the California Supreme Court, since it addresses fundamental voting-rights issues.  
 
Invoking the specter of a Florida-style polling debacle, the governor's lawyers claimed voters will be disenfranchised because counties do not have enough money or time to properly prepare for the October 7 election.  
 
They also want the court to allow Davis to add his own name to the list of replacements on the recall ballot -- a list that appears to be growing daily. About 300 gubernatorial wannabes have taken out papers in advance of Saturday's official filing deadline.  
 
California election law specifically bars the subject of a recall from appearing as a replacement candidate, but the governor's lawyers say keeping his name off the list would violate the equal-protection rights of people who vote for Davis.  
 
And if that argument does not hold, Davis' lawyers are urging the court to delay the recall vote until the March primary. Without a delay, they say, the counties will have to use outdated punch-card machines and open fewer polling places to save money -- confusing and inconveniencing voters.  
 
"We're asking the Supreme Court here to avoid a train wreck," Davis' attorney, Michael Kahn, told a crowd of reporters after filing the petition in San Francisco. Kahn noted that the U.S. Supreme Court got involved in Bush v. Gore only after all types of voting problems -- and similar legal challenges -- were raised.  
 
By next spring, counties are expected to have replaced aging vote-counting machines that a federal judge has ordered decommissioned by March 1. The March primary -- crowded with Democratic presidential candidates -- will also be more likely to attract Democratic voters than a fall election.  
 
The four other Supreme Court challenges include two that would reduce the two-part Oct. 7 ballot to a simple yes or no decision on the recall, eliminating any vote for successors and replacing Davis with Lt. Gov Cruz Bustamante, a fellow Democrat.  
 
Another would remove two propositions from the recall ballot _ including the hot-button "racial privacy initiative" that some experts predict will drive more conservatives than liberals to the polls. The fifth petition questions the $3,500 fee and 65 signatures needed to get on the recall ballot.  
 
The National Association for the Advancement of Colored People has raised complaints similar to the issues cited in the petition Davis filed Monday.  
 
"This case has real potential," said Loyola Law School professor Rick Hasen, an election law expert.  
 
Still, it's anyone's guess which way the justices -- six Republicans and one Democrat -- will rule.  
 
Politically, it will be a slam dunk for the Democrats if the court decides the state constitution requires that Bustamante succeed Davis, said Mark Petracca, a University of California, Irvine political science professor.  
 
Though Republicans would "put all their energies into absolutely crucifying Davis," Petracca said, "in some ways it doesn't end up mattering. My guess is, interest in the recall plummets."  
 
Consultants to the recall campaign called the idea of a Davis recall without Republican challengers "preposterous, ridiculous" and unlikely.  
 
"A meteor can fall on the Capitol building and kill all the legislators, too," quipped Recall Davis Committee head Howard Kaloogian. "That's more likely than Bustamante becoming governor by stepping into it."  
 
Rep. Darrell Issa, R-California, bankrolled the gathering of the more than 900,000 signatures needed to put the recall question before the voters, and has said he is putting his own name on the ballot. Republican businessman Bill Simon, who lost to Davis in last year's general election, also has taken out nomination papers.  
 
So has Hustler magazine publisher Larry Flynt, a registered Democrat; Green Party candidate Peter Camejo; and a long list of gadflies and publicity seekers who could prove to be spoilers on election day.  
 
Recall consultant Sal Russo said a court decision to block candidates from succeeding Davis would cause a "serious voter revolt" that would damage the Supreme Court.  
 
Field Poll spokesman Mark DiCamillo said he hasn't polled voters about what in effect would be a Davis-Bustamante contest. He calls the growing range of scenarios and possible outcomes a "speculative wonderland."

(CNN) -- Gary Coleman, child star of the sitcom "Diff'rent Strokes," has placed his name among a host of other celebrities in the running for California governor.  
 
Coleman's candidacy was engineered by the East Bay Express, an Oakland-area newspaper, which paid his $3,500 filing fee, collected the necessary petition signatures and is promoting his candidacy in protest of the scheduled vote aimed at recalling Gov. Gray Davis.  
 
Coleman's campaign treasurer, Steve Buel, editor of the East Bay Express, told CNN that the actor's name "resonates with the voters."  
 
Buel said he had no trouble getting the necessary 65 petition signatures from Independent voters in Alameda County, which he gathered at a recent Oakland A's baseball game.  
 
The Alameda County Registrar of Voters confirmed Wednesday that a representative for Coleman filed the necessary petition signatures and paid the required fee at the courthouse in Oakland, California. He registered as an Independent.  
 
California voters will decide October 7 whether to recall Gov. Gray Davis, a Democrat, and who should replace him.  
 
"I thought (the recall) was a joke. They thought it was a joke. And I thought, hey, why not," Coleman, 35, told CNN. "I'm probably the least qualified for the job, but I'll have some great people around me."  
 
"It's true that there is a farcical quality to the entire recall effort. But Gary's candidacy is no more farcical than that of Arnold Schwarzenegger, or Arianna Huffington, or the comedian Gallagher," Buel said.  
 
Schwarzenegger, Huffington and Gallagher have all announced they will seek to replace Gov. Davis.  
 
Schwarzenegger's announcement came at a Wednesday afternoon taping of NBC's "The Tonight Show" with Jay Leno.  
 
Coleman, speaking shortly after film star Arnold Schwarzenegger announced he was running for governor, predicted that Schwarzenegger would win -- and Coleman said he would vote for the "Terminator."  
 
"Now that Arnold is in the race, there is no race. Gray Davis needs to pack his bags," he said. "I'm going to stay in the race, but I'm not going to campaign."  
 
On Diff'rent Strokes from 1978 to 1986, Coleman played Arnold Drummond, who, along with his brother, Willis (played by Todd Bridges), was adopted by a wealthy man after their mother, the man's maid, died.  
 
His trademark retort, "Whatchu talkin' 'bout," became a well-known catch phrase.

Surely - surely there are some worthy opponents who have signed up to be in the running for governorship.
 
More and more has been disclosed about AS - a lot of it good - apparently he's been a good businessman.  Then he's been called a womanizer.  Then the Kennedy's stated they will NOT support him.
 
I call California my home state and I hate all those "only in California" jokes.  This situation is one of great concern and seriousness yet, it's turned into a second-rate circus.   Cry
