Judge set to issue rulings in Bryant case
Thursday, October 2, 2003 Posted: 1:08 PM EDT (1708 GMT)

(CNN) -- The judge in the sexual assault case against Kobe Bryant is expected Thursday afternoon to release decisions on several motions, including whether the basketball player's accuser must attend next week's preliminary hearing.

Additionally, Eagle County, Colorado, Court Judge Fred Gannett will decide whether the media may attend the October 9 preliminary hearing in which prosecutors will lay out evidence against the Los Angeles Lakers star for the first time.

Prosecutors requested that Gannett bar cameras from the hearing because they are concerned that releasing the information could infringe on Bryant's right to a fair trial and the accuser's right to privacy.

On rare occasions in Colorado, such hearings have been closed to the news media.

Bryant is accused of sexual assault against a 19-year-old hotel employee when he was a guest at a mountain lodge June 30 in Edwards, Colorado, west of the Vail ski resort.

Bryant, 25, is married and has an infant daughter. He acknowledges he had sex with the woman but insists it was consensual and that he did not assault her.

If convicted, the Lakers player could face a sentence of four years to life in prison. If sentenced to a term of probation, he would receive 20 years to life. He also could face a fine of up to $750,000.

In August, the judge allowed the release of the warrant that ordered the arrest of the NBA star.

But affidavits and other documents containing details of what allegedly happened in Bryant's hotel room would be kept sealed, as would the search warrant.

The prosecution and defense had sought to keep all the material sealed, and members of the news media sought its release.

The judge must also decide whether Bryant's attorneys can introduce the woman's medical records during trial.

Defense attorneys had requested the accuser's medical records, contending they could reveal information about her grasp of reality, Court TV has reported.

A former roommate of the alleged victim said she had been hospitalized twice after suicide attempts in February and May.

"The key question is what triggered the hospitalization," Craig Silverman, a former Denver chief deputy district attorney, told Court TV. "Was it the unsatisfactory end of a relationship with her boyfriend? The defense could argue that [the victim] acts irrationally and destructively when she experiences the unsatisfactory end of a relationship with a man."

A judge previously denied a Colorado paper's request for transcripts of 911 tapes of calls placed from the woman's home, according to Court TV.

KOBE BRYANT will be sitting in front of an Eagle County, CO, judge tomorrow, and Denver Post reporter STEVE LIPSHER has learned how the prosecution may be planning to shed new light on the physical evidence against the basketball star. Lipsher says the D.A. is prepared to call a strangulation expert to the stand, perhaps indicating there was some bruising on the alleged victim's neck. The prosecution has already asked for additional funds of about $300,000 to try what will no doubt be an expensive case. Kobe, who is charged with sexually assaulting a 19-year-old woman, has maintained he had consensual sex with the woman.
