Jackson to be formally charged Thursday

Thursday, December 18, 2003 Posted: 1:58 PM EST (1858 GMT)

SANTA BARBARA, California (CNN) -- California prosecutors are expected to formally file child molestation charges Thursday against pop star Michael Jackson.

Michael Jackson

Sources familiar with the case also said District Attorney Tom Sneddon has agreed to delay Jackson's arraignment a week to January 16 and return Jackson's passport to allow him to travel overseas

Sneddon said the charges would be filed around 1 p.m. (4 p.m. EST) in the Santa Barbara County Superior Court in Santa Maria, a working-class town close to Jackson's Neverland ranch.

"I will conduct a short press briefing at the location immediately following the briefing," he said in a written statement.

Sneddon earlier had pledged to file charges this week and scoffed at suggestions his case was falling apart.

"Everything will become clear when the charges are filed," he said earlier this month.

Jackson, 45, was booked November 20 on suspicion of multiple counts of child molestation in Santa Barbara and is free on $3 million bond. The boy was 12 at the time of the alleged offense and is 14 now.

The singer and his lawyers maintain he is innocent, and contend that the boy in the current case and his family have brought the allegations for financial gain.

According to court documents filed Wednesday, Sneddon, Jackson and Jackson's attorney Mark Geragos reached an agreement for the singer's passport to be returned so that he can travel to Great Britain from December 20 to January 6. The agreement doesn't say why Jackson is traveling out of the country.

Last week, a memo from a Los Angeles child welfare agency was leaked to the news media in which the agency said the latest allegations of sexual abuse against Jackson are "unfounded."

Sneddon last week said he discounted the memo because his office has more information.

"Our investigators were aware of the contents of the memo prior to seeking the search warrants and arrest warrant for Mr. Jackson," Sneddon said.

Asked if thought the leaked memo hurt his case, Sneddon replied, "No, we are not worried."

Jackson was accused in 1993 of molesting a different boy, but formal charges were never filed and that case was reportedly settled for millions of dollars. Sneddon was the district attorney who looked into that case.

The Michael Jackson Charges

December 18, 2003
Official charges against MICHAEL JACKSON are expected to be filed at Santa Barbara Superior Court this afternoon at 1 p.m. (PST), according to a press release from Santa Barbara District Attorney TOM SNEDDON. Will there be enough evidence to try Jackson on multiple counts of child molestation? ET has the latest details.

Former Santa Barbara County Sheriff JIM THOMAS says he believes Sneddon has done his homework and will prove he has a strong case.

"Before he would have a judge approve a search warrant and an arrest warrant and then tell the world he was going to arrest Michael Jackson, he had to feel pretty good with his case, and I believe he does."

Thomas also says the charges will allege that the superstar molested this boy for over a month and may also use evidence collected during the 1993 investigation.

"It shows a pattern," he says. "We don't just have the boy today claiming he was molested, we have three boys claiming they were molested."

Court TV's DIANE DIMOND also weighs in and tells ET she's uncovered new details about what allegedly happened behind closed doors at Neverland Ranch.

"My sources say they have an eyewitness to this molestation," says Diane, "and that is the accuser's younger brother; that he was in the bedroom with Michael Jackson and this boy in the middle of the night and woke up to see at least one act of molestation."

But Jackson's defense team could shoot that allegation down by suggesting that the boys' mother, who has been portrayed as opportunistic, was behind both of their stories.

"I have been unable to confirm some of the harshest criticism of this mother," Diane tells ET. "I'm hearing from my sources close to the family that this mom is trying the best she can and when she saw her cancer-stricken son smiling, having a good time at Neverland, that meant the world to her. She thought she was watching him closely at Neverland -- but maybe she wasn't."

Officially, Jackson faces multiple counts under California Penal Code 288(a), a felony that accuses the pop superstar of committing a lewd act with a child under 14 years of age. At the time of his arrest, Jackson said in a statement that he "would never harm a child in any way. These scurrilous and totally unfounded allegations will be proven false in a courtroom." The controversy began November 18 when police descended upon Neverland Ranch, armed with a search warrant, and confiscated files, luggage, laptop computers and more. Jackson was in Las Vegas at the time shooting a music video and coordinated with authorities to arrange for his surrender. After flying in on a private jet to Santa Barbara, the entertainer was booked and released on $3 million bail -- his every step scrutinized by the media.

Michael plans to return to Neverland on Saturday to shoot a TV documentary to tell his side of the story, according to the new issue of Us magazine, on stands Friday. The magazine reports that Jackson insiders say the pop star wants to "clear up his image" and sell the show to a network to help pay his legal costs.

Unbelievable.......  I think MJ's personal appearance needs to be cleared up.  Problem is, most of his makeup is tattooed.
