Chiron gets subpoena on flu vaccine
Grand jury requests documents related to supply cut

WASHINGTON - Chiron Corp. said Tuesday it received a grand jury subpoena from the U.S. Attorney’s Office for the Southern District of New York requesting certain documents and materials related to its Fluvirin influenza vaccine.
 
The subpoena also seeks information on the suspension of Chiron’s license to manufacture the Fluvirin vaccine by Britain’s Medicines and Healthcare Products Regulatory Agency, according to a filing with the Securities and Exchange Commission.
 
Chiron, based in Emeryville, Calif., said it intends to fully cooperate with the U.S. Attorney’s office in its investigation.
 
The Medicines and Healthcare Products Regulatory Agency last week temporarily suspended the company’s influenza vaccine manufacturing license at its Liverpool facility.
 
As a result of the license suspension, Chiron won’t sell Fluvirin for the 2004-2005 season.
 
The suspension resulted in a loss of 46 million to 48 million doses of the vaccine, causing an expected huge shortage in the United States heading into the flu season.
