Judge Refused Order To Reinsert Feeding Tube

TAMPA, Fla. - A federal judge on Tuesday refused to order the reinsertion of Terri Schiavo's feeding tube, denying an emergency request from the brain-damaged woman's parents. The parents' lawyer quickly filed a notice with the federal appeals court.
 
The ruling by U.S. District Judge James Whittemore comes after feverish action by President Bush and Congress on legislation allowing her contentious case to be reviewed by federal courts. The judge said the 41-year-old woman's parents had not established a "substantial likelihood of success" at trial on the merits of their arguments.
 
A notice of appeal was electronically filed hours later Tuesday morning with the 11th U.S. Circuit Court of Appeals in Atlanta by David Gibbs III, an attorney representing Terri Schiavo's parents. The notice tells the court that the full appeal will follow.

All I can say to this Judge's order is this man has a heart.
Let her go!  Never would I do this to my daughter, whom I love with all my heart.  Sometimes we have to face facts.

What a lot of people don't realize is that when a feeding tube is discontinued in a brain dead patient, they do not suffer.  They have no pain or sensation in their body.  You can try to stimulate any area with pain, and they do not respond.  She will not suffer.

My b/f and I disscused this issue after seeing it on the news.  We both agree that we wouldnt want to live this way.  My parents are also aware of my wishes.  This poor women Im sure wouldnt want to live like this.

The lesson here is to get your wishes in writing.  Terri has supposedly made her wishes clear verbally to several people, but in the end that meant nothing because it wasn't in writing, and here she is still tied up in the courts.

........and today they are still trying to get a ruling to have the feeding tube reinserted.  
The 3 Judges hold firm to let her go in peace.
 
What boiled my blood last night was when I saw celebrities getting involved.  
Stay out of it, it's not your call!  
Get it through your head people, the Cortex of her brain is gone!

Yes, because it wasn't three judges who denied the rquest. It was 2.  One judge very emphatically wrote a dissenting opinion, saying that the family only wanted more time to allow further review of the case, and that the justices weren't supposed to rule on teh case itself

It's an interesting example of our legal system that this case can never really be ruled on, it just goes on and on with more appeals and lawyers and judges, etc. etc. etc.  It's a good example of why Scott Peterson will probably die of old age before he's executed as well.

Well there is the supreme court, can't go much farther than that.  I can't believe how big this thing has gotten.  It just amazes me.  This can't be the first time this has happened, same with the peterson thing, men kill their wives all the time, yet none got the notoriety he did.  Same thing again with that little Jonbonet girl. Children get kidnapped and killed everyday.  I wonder why the media (and thus the rest of us) Pick up on some stories and not others.

Jon Benet is an easy one, cause she was this pretty little blonde haired blue eyed girl.  I can guarantee if she had been african-american or fat or anything other than this picture-perfect looking little girl, her case would never have gotten the kind of media attention it did.   With the Shiavo case, I suspect it has a lot to do with the location (Florida) and the intrusiveness of the politicians, like Bush in Florida during a time when we are pretty strongly divided politically as a country.  I'm pretty sure I never heard of the case until he got involved, although the local Floridians probably heard about it quite a bit.  With Peterson, it was because she was pregnant and pretty.  Once again, if she'd had horrible acne and 4 missing front teeth, she'd have never made the news like she did when she disappeared.

Wanted to add that I've noticed the same thing with the Amber Alerts.  If you watch the ones that broadcast in here and compare it to the ones that get run on CNN at the same time, there's a huge discrepancy.  I was actually quite surprised to see this last one get aired on CNN.com because the children are African American.   In general the ones that get run on CNN are all white and "pretty".

Gov. Jeb Bush just had a news conference.  Terri Schiavo has been MISDIAGNOSED!  She is just in a light coma and now he will push for tube reinsertion.  I can't believe how far they will go to get their way!

She's not in a coma at all as far as i can tell.  She's wide awake.  I thought coma meant a state of deep unconsciousness? That's the most awake unconscious person i ever saw!
