DENVER (AP) -- A female senior at Grand Junction High School who can't play volleyball because she didn't make the varsity team filed a lawsuit Monday alleging the school treats girls differently than boys.
 
Unlike boys who play football, girls don't have the option of playing on the junior varsity volleyball team if they fail to make the varsity team, according to the lawsuit filed in U.S. District Court.
 
Jessica Wieker's lawsuit alleges Mesa County Valley School District No. 51 discriminates against girls, which is a violation of a federal law known as Title IX that guarantees equal gender access to public education.
 
An after-hours phone message left at an answering service for the district was not immediately returned. Wieker's attorney, Michael Grattan III, also did not return an after-hours phone message.
 
Wieker also alleges the school treats girls differently by not offering as many opportunities for sports for girls and provided buses with onboard bathrooms for the football team, while the girls' volleyball team travels to games on district-owned vans driven by coaches.

That's not discrimination, its where the money is.  People pay more to see boys football than girls volleyball.  Therefore there's more money for them to get a bus rather than a van.  
 
I bet the chess team doesn't get a bus either  Roll Eyes

I agree with what's been said.  I mentioned to my husband last night, "This isn't gender discrimination, it's football discrimination!"  I grew up in a small town where I was a theatre student, and let me tell you...one year a 3 million dollar bond levy passed and of that, my department got exactly $300.  The football team on the other hand got a new field, new uniforms, new bus, etc.  they also added 6 new tennis courts, and a second gym for basketball with a wrestling loft over it.  In the meantime we performed our plays on a small choir stage in the cafeteria.  To this day I dislike football and most sports.  I can't watch them and while I no longer feel the sharp bitterness towards them I once did, I just can't learn to enjoy the sports.  I understand how this girl feels, but it has absolutely nothing to do with her gender and everything to do with the sport.

It even happens to the guys.
 
When I got to HS I had been playing baseball for the past 10 years. I am a left handed pitcher and back then I was sporting a nice 90 mph fastball along with a nasty curve.
 
The HS baseball coach also coached a local team in the off season. Amazingly enough 95% of the HS team was on his other team. If you weren't on that team you stood little or no chance of making the HS team.
 
I had a much better record pitching than most of the other pitchers and didn't make the team. After that I lost my love of baseball and stopped playing the following year.
 
Guess I should have sued like everyone else eh?

Life isn't always fair and as kids in sports this  
is where we all learn what is fair and not fair!
 
Football brings in MORE money to the school than any other sport.  I'm sure if your Drama Class had put on a play that drew this big a crowd, concession and gate receipts, they would have gotten what they needed.
 
When we were in High School it was both our Basketball Teams that drew the crowds and concessions.  Yes, we got new Uniforms, Glass Backboards and nice Jackets with our  
winning patches on the sleeve.
 
As a parent, I would hate to know I raised my children  
to sue when they don't get what they want!
 
A Lawsuit isn't the answer in this case at all!

Back in 95 I was in a bad accident that left me in a wheelchair and crutches for months. I had lawyers calling me left and right to sue for an outrageous amount.
 
I sat down and figured out what I lost in wages, etc and came to the insurance company with what I thought was a fair amount (about 1/3 to 1/4 what the lawyers said I could get).
 
When I told the insurance co. what I wanted their jaw dropped and she said she would get the paperwork out to me that day to sign and have the check to me in a week or so. She even asked me twice if I was positive it was all I wanted. I explained it was what I thought was fair and due and did not want to get something that was not rightly mine to ask for.
 
Don't get me wrong. The human side of me regrets not getting more out of it but I feel better having done the right thing and that outweighs the monetary gains I could have gotten.
