Suit planned over boy's ignored 911 call
Child, 6, was scolded by operator for playing on the phone

Monday, April 10, 2006; Posted: 11:54 a.m. EDT (15:54 GMT)

DETROIT, Michigan (AP) -- A lawyer said he plans a lawsuit over the death of a woman whose young son called 911 to report she had collapsed, only to be told he shouldn't be playing on the phone.

Geoffrey Fieger, best known for defending assisted-suicide advocate Jack Kevorkian, is representing the boy, Robert Turner, who turned 6 last month.

Fieger said Sherrill Turner, who had an enlarged heart, would have survived February 20 if help had been sent immediately.

The boy recounted his talk with the 911 operator on Sunday's "Today" show on NBC.

"She thought I was playing on the phone," Robert said.

By the time authorities arrived, Sherrill Turner, 46, was dead. (Full story)

"This indicates an endemic problem," Fieger said. "There's a discounting of children. Robert did exactly what he was taught to do."

Detroit police are investigating the 911 response. A spokesman did not immediately return a call Sunday.

After Turner collapsed, Robert placed two calls to 911. In the first call about 6 p.m., Robert told an operator his mother had passed out, but an operator asked to speak with an adult.

When he called back about three hours later, an operator told him: "You shouldn't be playing on the phone."

Police arrived after the second call.

In a statement Friday, Police Chief Ella Bully-Cummings said it was important not to rush to judgment and indicated she would have no further comment because of "imminent or impending litigation."

Fieger said he plans to file the wrongful death lawsuit against the city of Detroit on Monday.

....sure is, makes me furious to even see this on the news.
This woman should have been fired on the spot!

Oh, he'll get a monetary settlement, but never have his Mother!
No doubt a lot of parents over the USA are questioning teaching
their children to use 9-11.  Hopefully they will  learn there are
stupid adults in this world also!  Guess the dispatcher has no children!

Wow, That's too bad...The kid called twice.   The operator should have done something at that point.

WTF? Shocked   I guess you people think it's alright to KILL U.S. citizens, but mention shooting (not necessarily killing) an ILLEGAL immigrant, and everybody wants to run you out of town on a flagpole.

I just don't get it. Undecided

I must have missed that...I would certainly not advocate killing anyone over this.  One more death isn't going to bring this woman back or heal this little boy.  She needs to be fired, but she also needs to make some kind of restitution to this family.  We don't just kill people because we're angry at them or because they did something wrong.  We kill people under extreme circumstances, like this guy in court for September 11th, and that's the only reason we should kill someone, because of extreme circumstances.

It's really sad to hear about this only until now.

The boy can never get back his mom, never. It's just tragic. Sigh...

This operator should not only be fired, but should be feeling remorse that she had destroyed the life of a young boy who had not even reach 6 years of age.

Perhaps we should be looking at things from a different point of view. Parents these days should strictly tell their children to only call the emergency number when an accident happened and not be fooling around with the number. Then tragedies like this can be prevented.

This was such a tragic and infuriating story! I was just incensed when I heard the tape on the news. I can't even wrap my head around the fact that this woman was not fired immediately. The job of these 911 operators isn't to try and determine whether the situation is or isn't legit (although of course it would be wonderful if they really COULD weed out the imposters) - it's to make sure that people in danger are given proper attention immediately. This horrible lapse in judgement deserves more than just the slap on the wrist that it seems she's getting, and that's really only from the media! Let the cops have her.
