Whatever the Case May Be
(Kate)
 
Kate is in a tree picking fruit, after she comes down, she hears a noise in the jungle.  She picks up a rock and throws it toward the noise, and hits Sawyer.  He’s been following her to “protect her.”  He grumbles that she hurt his knee… they hear the sound of running water and go through the trees to find a waterfall.  Sawyer strips down and jumps in to “soak his sore knee.”  He talks Kate into joining him… she strips down to her undies and jumps in.  They play around, dunking each other, just relaxing and enjoying the swim.  They climb up onto the rocks and dive in.  Kate is going deeper when she sees something on the bottom.  She and Sawyer swim down further to see what it is… and find two dead bodies, a man and a woman, still strapped into their airline seats.  They both surface, Sawyer asks Kate if she’s ok, and then dives back down to check it out.  Sawyer finds a wallet on the male body, Kate finds a briefcase under the male’s seat.  Kate accuses Sawyer of being disgusting.  He remarks that “HE’s” disgusting but she’s not? (for getting the case).  She tells him, it’s hers.  They go back and bring the case back up.  He asks her for the key.. she doesn’t have it.  
 
SAWYER: This case isn’t yours, is it?
KATE: No.
SAWYER: Then you wouldn’t mind if I just take it.
KATE: I don't care.
SAWYER:  That's not what it looks like. Something you want to tell me about this little suitcase, Freckles?
KATE:  Take it.
 
Back on the beach:
The tide is rising, everything is being washed out to sea.  The survivors are scrambling around trying to save what they can.  They have to relocated the site further down the beach.  Jack tries to get them to all relocate to the jungle.  Sayid tells him that people don’t feel safe living in the jungle, with Claire being taken and the “monster.”  Jack tries to get Sayid to take him to Rousseau so he can find out about “The others” and see if they might have taken Claire.  Sayid tells him that her mind is gone, there are no whispers/others – it’s just the wind.  All he heard was the wind.  They discuss the maps and documents that Sayid took from Rousseau’s camp.  Charlie sits on the beach just staring out to sea while everyone else is rushing around trying to save stuff.
 
Shannon is sitting reading a magazine.  Boone comes up.  She asks him where he and Locke are going everyday.  He tells her they are looking for Claire.  When she says she thought they’d lost the trail, he tells her at least he’s trying to help… she’s just useless.
 
Kate sitting by the fire, Sawyer walks by, case in hand.  Kate flashes back to a bank:
 
MARK HUTTON: Okay, Miss Ryan…if you'll just give me some I.D., we'll get started on your loan app.
KATE (AS MAGGIE RYAN):  Okay.  Here you go.
 
MARK HUTTON:  So, what brings you to New Mexico?
KATE (AS MAGGIE RYAN):  My work.
MARK HUTTON:  What line of work is that?
KATE (AS MAGGIE RYAN):  I'm a photographer.
MARK HUTTON:  What do you photograph?
KATE (AS MAGGIE RYAN):  I've been commissioned for a coffee table book.  
Uh, pictures of old theaters in small towns.
MARK HUTTON:  Oh, there's a fantastic one down in Ruidoso.  You can't miss it.  
It's right off the main road.
KATE (AS MAGGIE RYAN):  Well, if I end up using it, I'll have to make sure I  
give you an acknowledgement, Mr., uh, ... Hutton.
MARK HUTTON:  Mark.
 
The doors fly open and two men with guns, wearing ski masks come in.  People start screaming, and a shot is fired in the air.  The gunmen tell everyone to get down, shoot out the security cameras, etc.  Hutton tries to press the alarm button under his desk, and the gunmen tell him not to even try it.  Everyone gets on the floor, and has their head down.

 
Back to the beach:
 
Kate sneaks into Sawyer’s tent and tries to steal the case.  He wakes up and they wrestle around a bit for it.  She tells him to give it to her.  He tells her no.  She eventually gets mad and leaves.
 
(Next day) Shannon lying on the beach, Sayid comes and asks her to help him decipher the French notations on the documents/maps.  She tells him she can’t do it.  He asks her to try.
 
Sawyer is sitting trying to pick the lock on the briefcase with a bobby pin.  Michael tells him he can’t do it.  That if he can pick the lock on a “Halliburton” he’ll put him on his back and fly him to L.A. Sawyer tells him to find a runway, there’s not a lock he can’t pick.  Hurley walks up, asks what he’s doing… Michael says “Trying to pick the lock on a Halliburton”.. Hurley just laughs, “Good luck.”  They tell him there’s no way to pick the lock on it, the only way to open it is “impact velocity”.. hit it with something like a sledgehammer, or the axe.
 
Locke and Boone in the woods with the axe.  Locke asks if anyone saw him take it.  He says no, and they go to work.
 
Rose and Charlie on the beach, Rose is dragging a piece of metal across the beach:
ROSE:  Hello, Charlie.
Charlie doesn't say anything.
ROSE: Oh, that's right.  You're not talking much these days.  But it doesn't mean you get to be rude.
CHARLIE:  Excuse me?
ROSE:  Everybody else is helping us move the camp up the beach, except for you.
CHARLIE:  Are you serious?
ROSE:  You think you're the only one on this island that's got something to be  
sad about?  Baby, I got sob stories for you, so why don't you grab the other end  
of this thing and help me? (Rose picks up her end of the metal and Charlie just sits there)
ROSE:  Well?
Charlie gets up and picks up the other end and helps her carry the metal.
(Note: Some people have said that Rose, particularly in this scene, reminds them of Mother Abigail in The Stand)
 
Sawyer is in the jungle, trying to open the case still, smashing it against a rock.  He repeatedly throws it at the rock, and the case just bounces back.  He then decides to climb a tree and throw it at the rock.  He climbs high in the trees and throws it as hard as he can down to hit the rock.  He’s in the tree lamenting the fact that it still didn’t open when Kate runs out of the bushes and grabs it.  She takes off running, Sawyer climbs down and runs after her through the jungle.  Sawyer runs out an angle and manages to get ahead of her and tackles her as she comes by.  Sawyer grabs the case.  He tells her if she’ll tell him what’s in it, he’ll give it to her.  She finally agrees and we flashback to the bank:
 
JASON:  I'm tired of asking nice.  Give me the money cage key now.
MARK HUTTON:  You're just going to kill me anyway.  Why would I give you --
JASON:  You think we're having a conversation here, huh?  
GUNMAN (BASEBALL CAP):  Everybody be cool! Do you wanna go home?  
GUNMAN:  Don't look at me! Look at the floor!
GUNMAN:  Everybody be calm.  Stay down.
JASON:  Listen to me, I am not gonna ask you again.  I want that key!
TRUCKER:  I can take him.  
KATE (AS MAGGIE RYAN):  What?
TRUCKER:  The tall guy, he's not watching us. I can take him.
KATE (AS MAGGIE RYAN):  You're not ...  
TRUCKER:  It's now or never.  Keep your head down.
 
The trucker jumps up and runs toward the tall gunman, the other gunman sees him.
 
GUNMAN (BASEBALL CAP):  Hey! Hey! Watch out!
 
The trucker grabs him, he drops the gun and it slides across the floor to Kate.
 
TRUCKER:  (shouts)  Pick it up!  Pick it up!  Shoot him!  Shoot him!
(she just looks at it)
 
VOICE:  Don't let him go!
VOICE:  Get him off, man!
 
Kate picks up the gun.
TRUCKER:  What's wrong with you?  Shoot the gun!
JASON: Cover him!
Jason goes to take the gun from Kate, both pointing their guns at each other.
 
TRUCKER:  Shoot him!  Shoot him!  Turn off the safety!
JASON:  Give me that gun.
TRUCKER:  It's on the side!  Turn it off!  On the side!  Turn it off!
KATE (AS MAGGIE RYAN):  I don't know how to use a gun!
 
The gunman in the baseball cap hits the trucker over the head and knocks him out.  Jason takes the gun from Kate.
 
GUNMAN (BASEBALL CAP):  You wanna get shot, Fat Boy? Huh?
 
Jason gives the gun to one of the others and grabs Kate by the neck…  
 
JASON:  Okay, little hero -
KATE (AS MAGGIE RYAN):  No, please, don't.
JASON:  Shut up! Let's you and me go talk. Huh?  Right in here.  Let's go.
 
Jason pushes her to the back of the bank with everyone watching.  She stumbles and almost runs into a desk.  He slams the door behind him and takes off his mask.  Kate is laughing.
 
JASON:  "I don't know how to use a gun"? That's classic.
KATE (AS MAGGIE RYAN):  Yeah.
 
They kiss.

 
Back on the beach Sayid and Shannon are working on the maps, she still says she can’t translate the French.  Sayid keeps encouraging her to try.
 
Jack and Sun are in the cave, Sun gives him a plant and through bits of signing to each other, he figures out that it is for headaches.  Kate comes in and tells Jack they “have a problem.”  She tells him the air marshal who was escorting her had a briefcase with guns in it, and that she and Sawyer found it and Sawyer has it.  She tells him it’s just a matter of time until Sawyer gets it open.  She knows where the key is… it’s in the marshal’s wallet. The decide to go dig up the body where Jack buried it, and get the key.  Jack keeps asking her what else is in the case.. she says nothing.  He tells her if he does this, they open it together.  She agrees.  
 
Back to Charlie and Rose on the beach, they’re dragging some suitcases down the beach on board:
CHARLIE:  Why are you smiling?
ROSE:  Am I?
CHARLIE:  You look happy.
ROSE:  Well, I guess I must be then.
CHARLIE:  There's no reason to be happy.  Things are awful.
ROSE:  They're not that awful.
CHARLIE:  We're stranded on an island.  No one's coming for us.
ROSE:  You don't know that.
CHARLIE:  Well, what I do know is there's something in that jungle that eats  
people.  Just because we've not heard from it in a couple weeks doesn't mean it  
won't get hungry again.  And I know there's a person or people that are trying  
to hurt us.
ROSE:  Charlie, nobody blames you.
CHARLIE:  What?
ROSE:  For what happened to Claire.  It's not your fault.  You did everything  
that you could do, and you came very close to dying yourself.
CHARLIE:  (quietly)  Yeah.  Maybe I should have died.
ROSE:  You know what I think, Charlie?   You need to ask for help.
CHARLIE:  Who's gonna help me?
 
Back to Jack and Kate, as they start to dig up the marshal’s body, Kate flashes back to the bank:
 
KATE (AS MAGGIE RYAN):  (v.o.)  So you ready to do this?
 JASON:  Hell yeah.  By now their imaginations are running wild.
KATE (AS MAGGIE RYAN):  Don't hold back.  He won't talk if the details are off.
JASON:  You and your details, Maggie.
 
Jason hits her across the face, and splits her lip.  He opens the door and shoves her back into the main part of the bank.
 
JASON:  Okay, hero ...  
KATE (AS MAGGIE RYAN):  No, please, don't.
 
She fall on the floor in front of the others.
 
JASON:  Shut up!
GUNMAN:  Everybody just relax!
GUNMAN:  I said quiet.
JASON:  Okay, Mr. Manager, you want to be a hard-ass?  Protect a vault that  
doesn't even belong to you?
 
Kate looks at him and shakes her head as she wipes the blood off her lip.
 
JASON:  Okay. There's gonna be consequences.
KATE (AS MAGGIE RYAN):  He's gonna kill me anyway.
 
Jason grabs Kate and points a gun at her head.
 
JASON:  I swear to god, if you don't shut up -- You got three seconds to give me  
that damn key.  One ... two ... (he cocks the gun.)  three.
 
MARK HUTTON:  All right.  I'll give it to you.
 
Jason shoves Kate back to the floor.
 
JASON:  Good.  Let's go.
JASON:  Right around here.  Let's go.
 
(Kate raises her head.)

 
Back in the jungle, they’ve dug up the body, and Kate gets the wallet from the body.  She turns away, coughing and gagging, as she opens the wallet.  It is full of maggots.  She throws it down.  Jack picks it up, checks and says, “There’s no key”… Kate, innocently replies “There isn’t?”  He tells her, no, but that was a great slight of hand, and to open her hand. She has the key.  He takes it and walks away.
 
Back on the beach Shannon is trying to translate the French.  She tells him it says “The sea of silver sparkles that change” and “Next to the pond, blue infinity”.. he tells her that can’t be right.. should be about longitude and latitude.  She says it sounds familiar.  He tells her it’s nonsense.  She gets frustrated with him and starts yelling, he tells her this was a mistake.. she says, “yeah, haven’t you heard.  I’m useless!” and walks away.
 
Jack goes to Sawyer to get the case.  Sawyer wants to know why he thinks he’ll give it to him.  Jack tells him if he doesn’t he’ll stop giving him the antibiotic for his knife wound, and it won’t heal.  Sawyer isn’t sure if he will or not, but he gives him the case anyway.  
He goes and gets Kate, and tells her they are going to open it together, because that’s what he said he’d do.
 
Flashback to the bank: [I]
JASON:  (v.o.)  What the hell you waiting for?  Open the damn thing! Hell, now we're talking.
 
The gunman shoves Kate into the open vault.  
 
KATE (AS MAGGIE RYAN):  Please don't. I --
GUNMAN:  Shut up.
 
They start putting money into the bag.
 
MARK HUTTON:  I let you in.  Now please let the girl go.
JASON:  (scoffs)  Let the girl go?  Man, you have no idea, do you?  The girl is the one who set you up.  The girl picked this bank.  Picked this vault.  This whole thing is the girl's idea. (he takes off his mask)
 
KATE (AS MAGGIE RYAN):  What are you doing?
JASON:  Easy, Maggie.  (He cocks his gun.)  Just cleaning up after myself.
 
Kate turns grabs the gunman’s gun out from his back waistband, and points it at Jason.
 
KATE (AS MAGGIE RYAN):  (to Jason)  You shoot, I shoot.
MARK HUTTON:  Wait.  What?
KATE (AS MAGGIE RYAN):  I said no one gets hurt.
JASON:  I know you're cold, baby.  But you're not that cold.
 
He cocks his gun and points it at Hutton.
 
Kate points downward and fires hitting Jason in the upper thigh.  
 
JASON:  Aah!  Ahh!
 
Kate points the gun at the gunman while she picks up Jason’s dropped gun.  The other gunman appears and wants to know what’s going on.  Kate shoots. him.  The taller gunman takes a step toward her, but she turns and shoots him also.
 
JASON: You shot me, you stupid bitch!
KATE (AS MAGGIE RYAN):  Shut up, Jason.
GUNMAN:  I told you not to trust her!
KATE (AS MAGGIE RYAN):  I need the key to safety deposit box 815 now.
MARK HUTTON:  Who are you?  
KATE (AS MAGGIE RYAN):  The key to the box now.
MARK HUTTON:  You need two keys -- the bank's and – (Kate takes out a key)  
If you had the customer key, why would you --
KATE (AS MAGGIE RYAN):  I'm not on the signatory card.
JASON:  You put me up to this to get into a safe deposit box?  I swear to god,  
you better kill me, Maggie, 'cause if you don't -
KATE (AS MAGGIE RYAN):  My name's not Maggie. (to Hutton)  Now go.
Kate removes the safe deposit box and puts it on the table.  She waits a moment then opens it.  Inside is a #10 envelope with something inside.{/I}
 
Back in the cave, Jack asks her again if there’s anything she wants to tell him before he opens it.  She says no.  He opens the case, inside are four guns, several bundles of cash, the ammunition and an envelope with “Personal Effects” written on it.  He opens the envelope.  Inside is a smaller folded envelope with something in it.  He asks Kate if this is what she wants.  She takes the envelope and opens it.  Inside is a small toy airplane.  He asks her what it is, she says nothing.. He asks her again.  She says, “You wouldn’t understand.”  He tells her just once he wants the truth.  She tells him it belonged to the man she loved.  Again, the truth.  Again, it belonged to the man I loved.  He tells her to stop lying, she says she isn’t.  He tells her again, “tell me the truth!”  She yells, “It belongs to the man I killed!”  She starts to cry.  He tries to console her, then packs the things back into the case, and leaves her crying.  
Back on the beach, the survivors finish up moving.  Walt is playing with Vincent.  Michael, Sayid, Shannon, Charlie and Rose are all moving bags.  
 
Later, as Rose sits in front of her fire, Charlie comes up and sits beside her.
 
CHARLIE:  Your husband was in the tail section of the plane.
ROSE:  Yes, he was.  But he'll be back.
CHARLIE:  You think he's still alive?
ROSE:  I know he is.
CHARLIE:  How?
ROSE:  I just do.  (she holds the ring on the end of the chain around her  
neck.)  It's a fine line between denial and faith.  It's much better on my side.
CHARLIE: (crying) Help me.
ROSE: (arm around Charlie, holding his hand) Baby ... I'm not the one that can help you.  
Heavenly Father, we thank you.  We thank you for bringing us together tonight and we ask that you show Charlie the path ...
 
Shannon and Sayid are on the beach.  She tells him the guy she knew in France, who taught her French, had a kid.. who watched the same movie over and over.  Sayid asks her why she’s telling him this.  She tells him the notations, are the lyrics to the song.  And just like the kid, the French woman wrote them over and over.  He asks her what the song is.  She sings it for him: (Boone is watching them from the trees.)

Jack walks by while Shannon is singing.  He stops and turns around to look at Kate sitting by the fire, with the toy airplane.
