'Bachelor' producers sue Guiney, record company

LOS ANGELES, California (AP) -- Bob Guiney, one of the stars of the popular ABC-TV reality series "The Bachelor," has been sued for breach of contract by the show's producers.  
 
In a lawsuit filed Friday, Guiney and his record company, Wind-up Records, were sued for promoting his new CD, "3 Sides," and music video.  
 
And Syndicated Productions Inc. -- a division of Telepictures Productions -- wants to stop Guiney from making any more public appearances in connection with the CD.  
 
The producers also are asking for unspecified monetary damages.  
 
Stars of "The Bachelor" and "The Bachelorette" series sign contracts with exclusivity clauses prohibiting them from promoting any other products without permission, according to the lawsuit.  
 
Guiney caught the public's eye in the first season of "The Bachelorette." After being rejected, he was picked to star in the fourth season of "The Bachelor."  
 
Michael J. O'Connor, a lawyer for And Syndicated Productions, did not immediately return a call seeking comment. There was no immediate response Sunday to a call seeking comment from Wind-up Records.

Thanks to a judge's ruling, Bachelor Bob doesn't have to sing the blues.  
 
Bob Guiney, the pudgy jokester from The Bachelorette who recreated himself as a slimmed-down Casanova to star in his own incarnation of The Bachelor, scored a legal triumph over the show's producers after a judge denied an attempt to block the reality star from selling his latest CD.  
 
And Syndicated Productions, the production company behind The Bachelor/Bachelorette series, slapped Guiney with a breach-of-contract suit after the would-be rocker began promoting his album, 3 Sides, by making public appearances, giving interviews and shooting a music video.  
 
It seems And Syndicated Productions believed Bachelor Bob's image belonged solely to the show's producers--who were, after all, the individuals responsible for "turning the previously obscure Mr. Guiney into 'Bachelor Bob,' a much-loved worldwide celebrity closely associated with the series," according to their lawsuit filed last week in Los Angeles.  
 
The production company accused Guiney of breaking an exclusivity clause in his contract that prevented him from promoting other projects without advance permission.  
 
In addition, And Syndicated Productions accused Guiney and his indie label, Wind-up Records, of sullying the series' "valuable brand name and goodwill by engaging in unauthorized and widespread media promotion" of 3 Sides.  
 
The company sought unspecified monetary damages from Guiney, and wanted sales of his CD halted immediately.  
 
However, the reality star's legal eagles argued that 3 Sides is Guiney's fourth album--he recorded the first three with his former band, Fat Amy--and that it is merely the latest release in a musical career spanning 12 years.  
 
"This is a case that should never have been brought," Guiney's lawyer, Charles J. Harder said in a statement. "Bob Guiney has the right to continue his 12-year career as a recording artist. It is ridiculous that [the producers] would try to stop him from earning a living."  
 
Harder said he was "extremely pleased" by the court's ruling.  
 
The so-called worldwide celebrity's album has met with fairly positive reviews on Amazon.com, where it was released exclusively in October.  
 
3 Sides has a current sales ranking of 353,833 on Amazon and scores four out of five stars based on the two customer reviews currently posted.  
 
Guiney tracks such as "Craziest Girl I Know" and "Girlfriend" have been compared to the likes of John Mayer and Matchbox Twenty.  
 
Viewers of the fourth installment of The Bachelor were treated to bonus Guiney vocals when he wooed several of his suitorettes on a pajama-clad group karaoke date.  
 
The curly-haired crooner eventually chose mortgage broker Estella Gardinier as his one and only; however, the two have since parted, according to the rumor mill.  
 
Meanwhile, scorned Bob suitress Meredith Phillips will be following in her dismisser's footsteps--she will be starring in ABC's next Bachelorette installment, which begins on January 14.

Good to hear the news!  After all, he was a singer before he was on The Bachelor Show and he sure didn't sing on the series, at least the viewing audience didn't hear him.  Maybe he only sang in the shower!  :yikes: :faint: Grin Lips Sealed

Yes, I had heard about this but never caught the ruling. All I can say is good for Bob!  For heaven's sake, no one owns the man.  He has to earn a living like the rest of us.

I agree.  I thought this was an interesting case and I am glad to see him win.  Shame on them for trying to stop the poor man from making a living.  It was clear he was a musician before he went on this show and that this was his job, he wasn't just trying to cash in on Bachelor fame.
